Martin Dominicus Cownhover, of Woodford County in the Commonwealth aforesaid, Farmer, and Mary his wife; William Hoggland of Fayette Co., aforesaid, House Joiner; Oakey Hoggland of Fayette Co., aforesaid Blacksmith; Levy Hoggland of Fayette Co., aforesaid Farmer; Diana Hoggland of Fayette Co. , aforesaid Spinster; and Johnson Hoggland of Fayette Co., aforesaid (which said Mary, William, Oakey, Levy, Diana and Johnson, together with Ann and Phoebe of New Jersey aforesaid, and their eldest brother, Martin Hoggland the younger of the Town of Lexington in Fayette Co., aforesaid House Joiner, are children of the said Marten Hoggland the elder by the said Rebecca his wife) Send Greeting: Whereas the said William Updike deceased in and by his last will and testament duly executed and attested, bearing date the tenth day of August, One Thousand Seven Hundred Eighty, did give and devise unto his daughter the said Rebecca the wife of the said Marten Hoggland, all that plantation whereon they then lived containing sixty five acres, being part of the land bought of James Perrin, adjoining Court Voreheis being eleven chains & thirty links wide, and also Thirty Five acres of Swamp adjoining the land of Moses Groms, and the late Dominieus Cownhover: to her and her said husband during their lives, provided they kept in possession of the said Plantation ; but if otherwise to the children of his said daughter Rebecca, their heirs and assigns forever. to be equally divided between them.... Said Testator did appoint his son Levy Updike, and his grandsons John & William Cownhover executors of his said will, and the said Testator by a codecel added thereto did direct that the sd exects should have the liberty to sell the sd land and premises. and they should execute a conveyance thereof for a proper consederation To all to whom these presents shall come.     Executors sold the 65 acres and purchased a house “being a Tavern" with a lot of land belonging thereto. —“And whereas it hath been concluded and agreed by and between the said Marten Hoggland the elder and his said children, to empower the said Marten Hoggland the younger, to sell and dispose of the said Tavern and Lott, and the Land and premises herein before mentioned (called thirty five acres of Swamp Land) or to cause the said Executors of the said Testator to do so. And that the money to arise by sale shall be received by the said Marten Hoggland the younger who is to purchase some landed property in fee simple in or near Fayette County Kentucky. aforesaid, as he or they shall judge most beneficial or convenient, which is to be held enjoyed by his said father and mother during their natural lives; and afterward to be equally divided between the said children pursuant to the directions of the said will.
    Now know ye therefore that the said Marten Hoggland the elder and Rebecca his wife. Marten Dominicus Cownhover, and Mary his wife, William Hoggland, Oakey Hoggland, Levy Hoggland, Diana Hoggland, and Johnson Hoggland, for the causes and considerations aforesaid, and to effectuate the said last recited agreement have made named nominated, constituted and appointed, and by these presents do make name nominate constitute and appoint the said Marten Hoggland the younger to be our true and lawful attorney....
